Rideshare Accident? Go Smart, GoSuits.

Get your free case estimate, takes 60 seconds.

A ride that should have taken you home can end in an emergency room. GoSuits handles rideshare accident cases in California, Texas and Illinois, including crashes involving Uber, Lyft and Waymo, and our attorneys can help you pursue compensation whether you were a passenger, another driver, a pedestrian or a cyclist. Rideshare claims are different from ordinary car accident claims because the driver, the app company and several insurance policies may all be part of the picture.

What applies to you depends on what the driver was doing when the crash happened: waiting for a request, driving to a pickup, or carrying a passenger. Each stage can trigger different coverage. If you or a family member was hurt, we can explain which stage applies and who is responsible.

30+ Years of Combined Experience

Our attorneys have litigated thousands of injury cases, including crashes involving Uber, Lyft and driverless vehicles. That background matters in rideshare claims, where several insurance policies may apply and the rules differ in California, Texas and Illinois.

You pay no attorney fee unless we recover compensation for you. Medical bills and other case expenses may still be owed. See how our fees work.

No Hidden Administrative Fees

We tell you up front what a fee agreement covers and how case costs are handled. If you hire our rideshare accident lawyers, the terms are in writing and we walk through them with you.

Fast Response Time and Available 24/7

Rideshare evidence disappears quickly. App records, trip logs and vehicle data can be overwritten unless someone sends a legal hold demand. Our intake team answers day or night in English, Spanish, Farsi, Arabic, Portuguese, Korean, Hindi, Tagalog, Urdu and Armenian, so you can describe what happened in your own language. The person who picks up can start that process, not just take a message.

Why you should not wait to act after a rideshare crash

The app record is the best proof of coverage. The rideshare company logs when the driver went online, accepted the request and started the trip. That record can decide which insurance policy applies. A preservation letter sent early keeps it from being overwritten.

Driver and vehicle evidence fades. Dash cameras, phone data and the vehicle’s own event data can show speed, braking and distraction. Once the car is repaired or the driver changes phones, much of that is lost.

Camera footage is often gone within days or weeks. Traffic cameras, storefront cameras and nearby homes may have captured the crash on a short recording cycle.

Statements can be used against you. Insurers often call within days. You have no obligation to give a recorded statement, and a casual comment about how you felt can be used later.

The statute of limitations for most injury claims is two years in California, Texas and Illinois. Claims involving a government vehicle or road condition can carry much shorter notice deadlines, and rideshare accounts often include arbitration terms that change where a passenger’s claim is heard, so it is worth speaking with a lawyer early.

Who can actually be held responsible?

The driver is the first party we look at. Rideshare drivers are treated as independent contractors, which is why companies often deny responsibility, but the company can still be a defendant when its own conduct is at issue, such as negligent screening, or when state law requires it to carry coverage.

Coverage generally steps up as a trip progresses. While a driver is logged in but waiting for a request, the company’s policy is usually more limited. Once the driver accepts a request and until the passenger exits, the companies must carry much higher commercial liability coverage. Amounts, and the rules for uninsured and underinsured motorist coverage, differ by state and have changed recently, so we confirm the policy in force on your date of loss rather than assuming.

Other parties may share responsibility too: another driver who caused the crash, a vehicle owner who rented the car to the driver, a manufacturer when a defect contributed, or a city when a dangerous road played a part. When a Waymo or other driverless vehicle is involved, the operating company is generally the party answerable for how the vehicle drove, and the evidence is different: sensor data, camera feeds and software logs, which must be requested quickly and in writing.

Six parties who may be responsible in a rideshare crash, from the driver and app company to a driverless operator and road hazards

What situations lead to rideshare accidents?

  • Distracted driving: Drivers glance at navigation, requests and messages while moving. Phone records and app logs can show it.
  • Fatigue: Some drivers work long hours across more than one platform, which raises the risk of drowsy driving.
  • Pickup and drop-off hazards: Sudden stops, double parking and doors opened into traffic or bike lanes put passengers, cyclists and pedestrians at risk.
  • Unfamiliar streets: A driver following directions may turn or stop abruptly.
  • Driverless vehicle errors: Autonomous vehicles can misread a scene, such as a pedestrian partly hidden by a parked car, or stop in a way that causes a rear-end crash.

How do rideshare cases differ from other car accident cases?

In an ordinary crash, one driver and one insurer are usually at the center. In a rideshare crash, there may be a driver’s personal policy, the company’s commercial policy, and your own coverage, and which one pays first depends on the app status. Rideshare companies also have legal teams that handle claims centrally and may offer a quick settlement before the full extent of your injuries is clear.

A passenger faces a further issue. Rideshare terms of service often include arbitration clauses and limits on where a claim can be filed. Those terms do not always apply, and they do not bind people who never accepted them, such as another driver or a pedestrian. We review the terms in every case.

How is a rideshare accident case valued?

Value depends on how badly someone was hurt, the treatment needed, and how the crash has changed daily life and work.

  • Medical expenses: Emergency care, surgery, rehabilitation and future treatment, documented through records and bills.
  • Lost income: Missed pay, and future earning capacity if the injury limits the type of work you can do.
  • Non-economic damages: Pain, emotional distress and the loss of activities you enjoyed. California, Texas and Illinois do not cap these in a standard injury case.
  • Shared fault: California reduces compensation by your share of fault with no cutoff. Texas and Illinois bar recovery once your share passes 50%.
  • Available insurance: The tier that applies may be a driver’s personal policy, the company’s commercial policy, or your own uninsured and underinsured motorist coverage.
  • Medical liens: Hospitals, lien providers and health insurers may be owed repayment. We negotiate these balances before the case closes.

What should you do in the days after a rideshare crash?

Get medical care the same day. Some injuries, including concussions and fractures, do not show their full effect right away.

Call the police and report the crash in the app. Get the report number. Keep your in-app description short and factual.

Save the trip record. Screenshot your receipt, the driver’s name, the vehicle and plate, and the trip route.

Document the scene. Photograph the vehicles, the road and your injuries. Collect witness names and note nearby cameras.

Speak with a rideshare accident lawyer first. Before you speak with any insurer, schedule a free consultation. We will review what happened, explain your options and handle the insurance communications so you can focus on recovering.

Frequently asked questions

Can I sue Uber or Lyft if I was hurt as a passenger?

Often you can bring a claim against the driver and, depending on the facts and the policy, the company’s insurance. The companies’ terms of service include arbitration language that may affect where the claim is heard. We review those terms in each case.
