Where do Irving crashes start?

Three freeways and a major airport meet inside this city. SH 183 runs east and west past the airport and through the commercial corridors of Irving. SH 114 (the John Carpenter Freeway) takes traffic through Las Colinas toward Dallas and Grapevine, and I-635 (the LBJ Freeway) runs along the city’s northern edge. Entrance and exit ramps come quickly, and drivers often have only seconds to merge or exit.

The streets behind the freeways are just as busy. Belt Line Road and MacArthur Boulevard carry long lines of cars through signals and shopping center entrances. Left-turn crashes and red-light collisions are common at intersections like these, and the frontage roads along the highways add conflict points as drivers cut across to reach an exit.

At rush hour, traffic on these routes compresses and releases, and rear-end collisions follow. At night and in rain, speeds do not always come down with the conditions.

A crash near DFW: rentals, shuttles and visitors

Travelers rent cars, hotel shuttles pull in and out, and rideshare drivers circle to pick up passengers. The result is a crowd of vehicles driven by people who are unsure where they are going. Sudden lane changes, wrong-way turns and braking at the last second are routine.

If you were hit by a rental car, the driver’s own insurance may apply along with a policy through the rental company, and the answer depends on the contract and the driver’s coverage. A shuttle or hotel van adds a business insurer and an employer that may be responsible for the driver. Rideshare crashes bring in the platform’s coverage, which depends on whether the driver had the app on and was waiting, heading to a pickup or carrying a passenger.

Because so many policies are possible, it helps to learn all of the coverage in play. Finding all insurance coverage after a Dallas-area crash explains how that search works.

Who is to blame when each driver has a different story?

Most car cases come down to one question, and the answer is rarely as clear at the scene as it seems. Texas uses proportionate responsibility, so a jury can assign each driver a percentage of the blame. We build the case around physical facts rather than who sounds more convincing.

Skid marks and vehicle damage show direction and speed. Event data shows throttle position and braking in the seconds before impact. Intersection signal timing records can show whether a light was red or green, and a business camera across the road may have the whole thing. We also look at cell phone records when distraction is suspected.

A police report helps but is not the last word. You can get a copy of the Texas crash report (Form CR-3) from the state’s online system, and if a fact in it is wrong, we ask the reporting agency to fix it. A ticket given to the other driver does not guarantee a result either, since insurers evaluate fault on their own.

Hit and run, uninsured and underinsured drivers

Drivers without insurance are a regular part of the picture in a large metro area. If the at-fault driver fled or has no coverage, your own uninsured and underinsured motorist coverage may pay medical bills and lost income, up to its limits. Check your policy for that coverage, and for medical payments or personal injury protection, which may pay bills regardless of fault.

After a hit and run, report it to the police immediately and write down everything you remember: partial plate numbers, color, damage, direction of travel. Ask nearby businesses whether their cameras caught it, and do so quickly, because many systems overwrite within days.

Injuries after car accidents in Irving

Whiplash, back and neck sprains, concussions, broken bones, shoulder and knee tears and facial injuries from airbags all show up after collisions. Many do not feel serious on the first day. What matters for your claim is that a doctor sees you, writes down what you report and follows up if you do not improve.

Baylor Scott & White Medical Center – Irving is one of the hospitals near the city’s main roads, and people injured here are treated at hospitals in Irving, Dallas and nearby cities depending on severity. Whichever you choose, keep your discharge papers, ask for imaging reports, and keep every appointment. Missing appointments hands the insurer an argument that you were not really hurt.

What an Irving car accident claim can include

Property damage covers repair or replacement, towing, storage and a rental while the car is down. An injury claim covers medical bills now and in the future, lost income, reduced earning ability, pain, mental anguish and impairment. In rare cases involving gross negligence, such as a driver who was badly intoxicated, Texas law allows exemplary damages.

Your net recovery depends on liens as well. Beyond pursuing the gross recovery from the at-fault insurer, we negotiate with hospitals, ER groups and medical lien holders at settlement to reduce what you owe out of the award, so more of the money reaches you.

Six losses an Irving, Texas car accident claim can include, from vehicle repairs to lien reduction

Trucks and delivery vans on the Irving corridors

Freight moves through Irving constantly. Trucks serving the airport, warehouses and distribution centers share SH 183 and I-635 with commuters, and box trucks and delivery vans make stops on surface streets all day. When a car collides with a heavier vehicle, the injuries tend to be worse and the insurance questions get bigger.

A company that employs the driver can be responsible for his negligence, and sometimes also for how it hired, trained or scheduled him. We ask for hours of service logs, dispatch records, maintenance files and any dash camera video. Those records have their own retention periods, so the earlier we ask, the better the chance they still exist.

Drunk and drowsy driving

Late-night crashes around hotels, restaurants and entertainment areas often involve alcohol, and early-morning airport runs bring drowsy drivers. In a case involving an intoxicated driver, a criminal DWI case may be going on at the same time, but it is separate from your civil claim. A conviction or a plea can help your claim, but the outcome of the criminal case does not decide yours.

In some situations a business that served an obviously intoxicated person may share liability under the Texas dram shop law. That is a narrow claim with strict proof requirements, so we look at receipts, witness accounts and surveillance video quickly. If the other driver was texting or on a call, phone records can establish that, but they must be requested before the carrier’s retention period ends.

Repairs, rentals and total losses

The car is the first thing insurers talk about, and it is where mistakes happen. If the other driver was at fault, you can usually pursue the cost of repair, a comparable rental and towing and storage fees. If your car is a total loss, the insurer owes its value before the crash, and you can push back on a low valuation by providing records of comparable vehicles, upgrades and maintenance.

Texas also recognizes diminished value for some repaired vehicles, meaning the loss in market value caused by crash history. It is easy to overlook, and the insurer will rarely raise it. Do not let the vehicle be repaired until photographs and, where possible, a data download are complete, because repairs change the evidence.

What to say, and what to keep to yourself

At the scene, stick to facts: where you were, which way you were going and where you hurt. Do not say you are sorry, do not say you are fine, and do not guess at speeds. Adjusters read your words for admissions, and a casual comment like “I didn’t see him” can be turned against you.

Keep your phone’s photos and notes. Do not delete anything, even if it seems embarrassing. Deleted material can look worse than the material itself, and the other side may ask for it.

Six dos and don'ts for what to say after an Irving car crash, from stating facts to avoiding casual remarks

Time limits and shared fault

A lawsuit over a car accident injury must generally be filed within two years of the crash, under Section 16.003 of the Texas Civil Practice and Remedies Code. Property damage claims are also typically two years. If a government vehicle was involved, such as a city truck or a transit bus, a shorter written notice period can apply.

Under Chapter 33, you recover nothing if your share of fault is over 50 percent, and your award is reduced if your share is 50 percent or less. That is why even a small allegation, such as that you were speeding slightly or did not brake in time, deserves a response.

Where a case ends up

Most Irving crash cases settle, often through negotiation or mediation. If one does not, we file in the Dallas County district courts in Dallas. Venue depends on where the crash happened and where the defendant lives. Before any filing, we talk with you about what to expect, how long it may take and what the other side will likely say.

You are welcome to schedule a free consultation to go over your crash, and if you are not certain whether your situation is a car case at all, our Dallas-area personal injury team can help sort that out.

Which Irving car accident cases do we take?

We take Irving crash cases of every common kind: rear-end and red-light collisions, crashes with rental cars, hotel shuttles and rideshare drivers, hit and run and uninsured driver claims, and drunk or drowsy driving crashes on SH 183, SH 114, I-635 and MacArthur Boulevard. These cases are handled by our Dallas-area car accident lawyers.

Some crashes are bigger than a car case. If a freight truck serving the airport or a warehouse was involved, our Dallas-area truck accident team handles the carrier and its records, and for injuries beyond the crash itself, our Dallas personal injury office can review the full claim with you.
