Reviews and Testimonials

30+ Years of Combined Experience

Our attorneys have spent decades handling injury claims, from car and truck collisions to premises and workplace cases. In McKinney that experience shows up in small ways, like knowing which questions to ask about a construction site’s insurance or how a Collin County defense lawyer tends to value a soft tissue injury.

No Attorney Fee Unless There Is a Recovery

You pay no attorney fee unless we recover compensation for you. Medical bills and other case expenses may still be owed. See how our fees work.

No Hidden Administrative Fees

Our fee agreement spells out what we charge and how case costs are handled. Nothing shows up later as a surprise filing charge or an administrative line item, which is how our McKinney personal injury lawyers prefer to work.

Fast Response Time and Available 24/7

Evidence moves quickly after an injury. A store’s surveillance video may be recorded over within days, and a vehicle’s event data can be lost once the car is repaired or sold. A legal hold letter sent early can stop that. You can reach us around the clock, and our intake team answers day or night in English, Spanish, Farsi, Arabic, Portuguese, Korean, Hindi, Tagalog, Urdu and Armenian, so you can describe what happened to a McKinney attorney in your first language. The person who answers can start the case, not just take a message.

What kinds of injury cases do we see in McKinney?

McKinney has grown fast, and its injury cases reflect that. Traffic crashes are the largest group, since commuters use US-75 (Central Expressway, which State Highway 121 joins in McKinney) and US-380 every day, and local streets like Virginia Parkway and Eldorado Parkway carry heavy turning traffic near shopping centers and schools. The rest come from everyday places: stores and restaurants around Downtown McKinney, apartment complexes, daycare centers, construction sites, and homes and yards where dogs bite.

Parents sometimes call after a child is hurt at a park or school event. Workers call after a fall from a ladder on a build, or a forklift incident at a warehouse. Texas law treats each of these differently, and that decides who we name and what we have to prove.

If you are not sure which category your injury fits, our Dallas-area personal injury team can look at it with you and tell you where it lands.

Who pays when someone is hurt in a growing city?

New construction means more contractors, subcontractors and property managers, and each of them carries its own insurance. After a McKinney injury we ask who owned the property, who maintained it, who hired whom, and who was supposed to warn you of the hazard. A fall in a newly built shopping center might involve the owner, a management company and a janitorial contractor, each pointing at the other.

For a car or truck crash, we look at the driver’s policy first, then at an employer if the driver was working, then at your own coverage. Texas drivers can buy uninsured and underinsured motorist coverage, and in a city this size it matters more than people expect. If the at-fault driver has little insurance, that coverage may be what pays your medical bills.

The first week: what helps your case and what hurts it

See a doctor, even if you feel mostly fine. Adrenaline hides pain, and soft tissue injuries and concussions can take a day or two to show up. Emergency care at Baylor Scott & White Medical Center – McKinney or Medical City McKinney leaves a dated record that links the injury to the incident. Insurers read gaps in treatment as a sign that you were not hurt badly.

Take photographs before anything is cleaned up or repaired. Get names and phone numbers. Keep your shoes and clothing as they were. Do not post about the incident online, and do not sign medical releases or give a recorded statement to the other side’s insurer until someone on your side has read what they are asking for.

One short rule: say what happened, not whose fault it was.

Six steps for the first week after a McKinney injury, from seeing a doctor to avoiding recorded statements

Job sites, daycares and other places where McKinney injuries start

With so much building underway, construction injuries come up often. Falls, struck-by accidents and trench or equipment incidents usually involve several companies on the same site. A worker’s own employer may be covered by workers’ compensation, which limits that claim, but a different contractor’s negligence can open a separate claim against that company. Some Texas employers choose not to carry workers’ compensation at all, and those non-subscribers can be sued directly for negligence.

Daycare and school injuries are different. The question is usually supervision: how many staff were in the room, what the ratios were, whether the playground equipment was inspected. Parents often learn what happened from a short note or a phone call, so we ask for incident reports and any video as soon as we are hired.

Dog bite claims turn on what the owner knew or should have known about the animal. A prior complaint, an earlier incident or a known tendency to attack matters a great deal. Neighbors who have seen the dog loose are often the most useful witnesses.

What injuries show up most, and why the paperwork matters

Broken bones, torn shoulders and knees, spinal injuries, concussions and burns appear in McKinney cases. What they have in common is that the claim depends on records. A treating orthopedist who writes down a limitation and its cause carries more weight than a client who says it still hurts.

Keep a simple log of symptoms, missed work, medications and tasks you can no longer do. Adjusters rarely credit pain that is not documented. If a doctor refers you to physical therapy or a specialist, go, and tell us if cost or scheduling is getting in the way. We can often help line up care, and a gap in treatment is one of the first things the other side will point out.

Children and older adults deserve extra attention. A child’s injury may affect growth or schooling for years, and an older person’s fall can lead to complications long after the initial treatment. We look at what the next ten or twenty years may require, not just the bills in hand.

How quickly does evidence disappear?

Faster than most people think. Store cameras often record over themselves in a matter of days. A business may throw out an incident report that nobody requested. A commercial vehicle’s electronic data and a company’s maintenance records can be overwritten or archived, and a damaged car gets repaired. Witnesses forget details or leave town.

That is why we send preservation letters right away and ask for photographs of the scene while it still looks the way it did. In a construction case we also ask for the site’s safety plan and daily logs, because those show who was supposed to supervise the work.

Where is a McKinney injury case filed?

McKinney is the county seat of Collin County, and civil injury lawsuits are filed in the Collin County district courts, which the District Clerk’s office in McKinney supports. The clerk lists 15 district courts that handle civil, family and felony criminal matters, and the Texas Supreme Court requires civil cases to be filed electronically. If a defendant lives in another county, or the incident happened elsewhere, the case may belong in a different county, and we sort that out before filing.

Most claims never reach a courtroom. A settlement can come after a demand letter, during discovery, or at mediation. We prepare every case as though it may be tried, because insurers pay attention to that.

How long do you have, and what if you were partly at fault?

For most personal injury claims in Texas, the lawsuit must be filed within two years of the day the injury happened. That rule appears in Section 16.003 of the Texas Civil Practice and Remedies Code. Some situations change the clock, including claims against a government entity, which can require early written notice, so do not assume you have two full years.

Texas also uses proportionate responsibility. Under Chapter 33 of the same code, you cannot recover if your share of the blame is greater than 50 percent. If you are 50 percent or less responsible, your damages are reduced by your percentage. A jury that finds you 20 percent at fault on a $100,000 loss would reduce the award by $20,000. This is why insurers push to assign you some of the blame, and why a few percentage points can matter.

What if a city street, a school or a state highway is involved?

Some hazards belong to a government body: a damaged road surface, a broken signal, a poorly marked work zone. US-75 and US-380 are state highways, while many neighborhood streets belong to the city. Claims against a city, a school district or the state follow special rules, including early written notice requirements and limits on what can be recovered. The notice period can be far shorter than two years, and missing it can end the claim. If a public road or building played a part in your injury, tell us at the first call.

What can you recover?

Economic damages cover the things with a receipt: medical care, future treatment, lost pay, reduced earning ability and property damage. Non-economic damages cover pain, mental anguish, scarring and the loss of activities you used to enjoy. In cases involving gross negligence, Texas law may allow exemplary damages, though they are limited and not common.

The settlement amount is not what ends up in your pocket. Hospitals, ER physician groups, health insurers and Medicare or Medicaid can claim part of the recovery. Beyond pursuing the gross recovery from the at-fault insurer, we negotiate with hospitals, ER groups and medical lien holders at settlement to reduce what you owe out of the award, so more of the money reaches you.

Dealing with the insurance adjuster

The adjuster who calls you within a day or two is usually polite and quick to offer a check. That early offer rarely reflects your future treatment, because nobody knows yet how long you will need care. Settling before you reach maximum medical improvement can close the claim for good while you are still treating.

Adjusters also ask for recorded statements, prior medical records and access to your social media. You are not obligated to give a recorded statement to the other driver’s insurer. If you want to understand your options before you answer, our overview of Texas filing deadlines is a good place to start, and you can schedule a free consultation to talk through the specifics.

Which McKinney cases do we take?

Many of the McKinney cases we see start on the road. Crashes on US-75, US-380, State Highway 121 and Virginia Parkway are handled by our Dallas-area car accident lawyers. Delivery and freight trucks use the same corridors, and a crash with one brings in a carrier, its insurer and federal safety rules, which our Dallas-area truck accident team works from the first week.

When someone is killed, Texas allows the surviving spouse, children and parents to bring a wrongful death claim, and the estate may bring a separate survival claim. Our Dallas-area wrongful death lawyers handle those cases. We also take construction, premises, daycare, dog bite and product injury cases from McKinney.

McKinney Texas personal injury lawsuit steps and process

Step 1 of 9

Collect all available evidence after a personal injury incident

We gather the police or incident report, medical records, photographs, witness names and any video from nearby businesses or doorbell cameras. For a McKinney crash we also look at traffic camera coverage and, where it applies, data from the vehicles. Preservation letters go out early so the other side keeps what it has.

Frequently asked questions

Do I need a lawyer for a minor injury in McKinney?

Not always, but a short consultation costs nothing. Injuries that seem small, such as neck strain or a mild concussion, can develop over weeks. An attorney can tell you whether a quick settlement is likely to cover what you will need, or whether it would close the claim too early.
