If you were hurt in a crash on Randall Road, on the Northwest Tollway, or on one of the older streets running down to the Fox River, the first weeks tend to be a blur of emergency room paperwork, a car in the shop and calls from an adjuster who is already asking for a recorded statement. GoSuits helps people in Elgin and across Kane County sort out what to do first and what can wait.

Claims here can involve other drivers, delivery and freight operators using I-90 and Route 20, property owners, employers and product makers, along with the insurers behind each of them. We take injury cases from the first call through settlement or trial, and we explain each stage in plain terms as it comes up.

Elgin clients are represented by our Chicago personal injury office on South Michigan Avenue. You can work with us by phone or video, and if needed, we can come meet you.

Reviews and Testimonials

30+ Years of Combined Experience

Our attorneys have spent more than three decades between them in Illinois, California and Texas courtrooms, handling crashes, workplace injuries, defective products and wrongful death claims. For an Elgin client that experience means a lawyer who has already seen how a Kane County file is built and how insurers value injuries here.

No Attorney Fee Unless There Is a Recovery

You pay no attorney fee unless we recover compensation for you. Medical bills and other case expenses may still be owed. See how our fees work.

No Hidden Administrative Fees

The fee agreement tells you what we charge and how case costs are handled before you sign. No surprise administrative charges show up at the end, which is the standard we hold for every client of our Elgin personal injury lawyers.

Fast Response Time and Available 24/7

After a crash or a fall, the evidence that proves what happened can vanish quickly. Dash camera footage, store video and vehicle data are often overwritten within days, and a legal hold demand is the step that stops that. Our intake team answers day or night in English, Spanish, Farsi, Arabic, Portuguese, Korean, Hindi, Tagalog, Urdu and Armenian, so an Elgin caller can describe what happened in their first language. The person who picks up can start the process, not just take a message.

Where does an Elgin injury case get filed?

Elgin sits mostly in Kane County, with a smaller part of the city in Cook County, and that split catches people off guard. A claim from an Elgin crash is usually filed in the Circuit Court of the 16th Judicial Circuit at the Kane County Courthouse, 100 S. Third Street in Geneva. If the accident happened in the Cook County portion, or if the defendant lives or does business in Cook County, the Circuit Court of Cook County can be the right venue instead.

Illinois has one trial court system. It is called the Circuit Court, and the circuits are numbered. Cases are not filed in a “district” or “superior” court here. The venue rules depend on where the accident happened and where the defendants live or do business, which is why we look at both before we file.

Many people assume that because they live in Elgin their case stays in Elgin. Branch courts in Kane County mainly handle traffic and ordinance matters, while injury suits are heard at the main courthouse in Geneva. It is a short drive from the Fox River valley, but it is worth planning around for depositions, hearings and any trial.

How long do you have to file, and what if you were partly at fault?

In Illinois, a personal injury lawsuit generally has to be started within two years after the cause of action accrues. That comes from 735 ILCS 5/13-202. There are exceptions for some situations, and claims against public bodies can carry much shorter notice requirements, so do not assume you have two full years without checking. Our knowledge base explains the Illinois statute of limitations for car accident claims in more detail.

Fault matters too. Under 735 ILCS 5/2-1116, if a jury finds you more than 50 percent responsible for your own injury, you cannot recover. If you are 50 percent or less responsible, you can recover, but your damages are reduced by your percentage. Insurers know this rule well, and they often try to push a little extra blame onto the injured person, such as a pedestrian crossing outside a crosswalk or a driver who braked late.

That is one reason we do not let clients give recorded statements early. A casual “I didn’t see him until the last second” can be repeated back later as an admission.

Randall Road, the tollway and the river crossings

Randall Road is the kind of corridor that produces injury claims without any dramatic cause. It is a retail strip with a lot of left turns, driveway entrances and stop-and-go traffic, and the most common crash there is a rear-end collision or a turning vehicle that fails to yield. Those facts sound simple, but who stopped, who signaled and who entered the lane first still need to be proved.

I-90, the Northwest Tollway, brings a different kind of case. Speeds are higher, trucks are mixed in with commuters headed to and from the Chicago suburbs, and a crash in a work zone or in rain can involve several vehicles. Fault in a multi-vehicle collision is rarely clean, and each driver’s insurer will point at someone else.

Closer to downtown, Route 20 and Route 25 carry traffic over and along the Fox River. Bridges and older intersections narrow sightlines, and in winter, ice on approaches and ramps turns an ordinary braking distance into a collision. A driver who was going too fast for the conditions can still be negligent even when the road was slick.

We pull the police report, request any traffic or business camera footage, and in some cases return to the intersection to see what the camera angles and signal timing show.

What kinds of injury cases come out of Elgin?

Car and motorcycle crashes are the most common, but they are not the only claims. Workers on Elgin job sites, in plants and in stores get hurt too, and while most Illinois employees are covered by workers’ compensation, some employers do not carry it. When an employer has no coverage, the injured worker may be able to sue the employer in civil court. Injured workers can also have a separate claim against a third party, such as an equipment maker or a negligent contractor on the same site.

Product liability claims come from defective vehicles, tools and household appliances, and they depend on keeping the product itself. Do not throw it away or send it back to the manufacturer.

Trucks are a fact of life near the tollway. A crash involving a commercial vehicle can bring in the driver, the carrier, a broker and a maintenance contractor, along with federal safety regulations. We also take wrongful death cases, brain injuries and SUV rollovers, and we handle property damage disputes that come out of the same events.

What should you protect in the first week?

Start with your health. Go to Advocate Sherman Hospital, Saint Joseph Hospital or the nearest emergency room, and describe every symptom, including ones that seem minor. Concussions and soft tissue injuries sometimes show up a day or two later, and a gap in treatment gives an insurer something to argue about.

Photograph the scene, the vehicles and your injuries before anything is moved or repaired. Get names and phone numbers of witnesses. Keep the damaged clothes and the broken product. Do not post about the incident on social media.

Request your police report. In Elgin, reports come from the Elgin Police Department at 151 Douglas Avenue, Elgin, IL 60120. Check the City of Elgin website or call the department to confirm how to request a copy, and have the date, time and location of the incident, the names of the people involved and the report number if you have it. If the crash was on the tollway, the Illinois State Police may have written the report instead.

Six steps to protect an injury claim in the first week after an Elgin accident, from medical care to social media

How do insurers value an injury claim?

An adjuster looks at medical bills, how long treatment lasted, whether you missed work, how the injury affects daily life and who they think was at fault. The number is not a formula. A fractured wrist with surgery, hardware and months of therapy is a different claim than a sprain that resolved in three weeks, and an injury to a person who uses their hands for work is valued differently than one to a person who does not.

Insurers also look for reasons to pay less: a delay before treatment, a prior injury to the same body part, a gap in appointments, or a social media post that appears to show you active.

Past medical bills are only part of the claim. Illinois law allows recovery for future medical care, lost earnings, pain and suffering and loss of normal life where the evidence supports it. Net recovery matters as much as the gross figure, which is why we negotiate with hospitals, ER groups and other lien holders at settlement to reduce what you owe out of the award.

Six factors an insurance adjuster weighs when valuing an Illinois injury claim, from medical bills to shared fault

What if the other driver has no insurance, or drives off?

It happens more than people expect. If the driver who hit you is uninsured, or leaves the scene and is never found, the claim often runs through your own policy’s uninsured motorist coverage. Its limits vary from policy to policy, so the first job is to pull your declarations page and see what you bought. Your own insurer is then on the other side of the table, and it can be just as slow to pay as a stranger’s.

Report a hit-and-run to the police promptly. Illinois policies commonly set conditions on how quickly you must report and cooperate, and missing one of them hands your insurer an argument.

What can an injured person in Elgin recover?

The recoverable losses fall into two groups. Economic damages are the ones with a receipt: emergency care, surgery, therapy, prescriptions, medical equipment, and wages you could not earn while you recovered. If an injury limits what you can do for work in the future, that reduced earning ability counts too.

Non-economic damages cover pain, suffering, disfigurement and the loss of the ordinary things you did before the injury. These are harder to put a number on, and they are where an adjuster and a jury are most likely to disagree.

In a wrongful death case, a personal representative files for the family, and the claim can include the family’s financial losses and damages for grief, sorrow and mental suffering under the Wrongful Death Act, 740 ILCS 180/2. If you have lost someone, we will walk through who is eligible and how the claim is brought when you call.

Which Elgin cases do we take?

Many of the Elgin cases we see begin on the road. Collisions on Randall Road, Route 20 and Route 25 are handled by our Chicago-area car accident lawyers. When a semi or a delivery truck on I-90 is involved, the carrier and its insurer become part of the case, and our Chicago-area truck accident team works it from the start.

When negligence takes a life, an Illinois wrongful death claim is brought by the personal representative of the estate for the surviving spouse and next of kin. Our Chicago-area wrongful death lawyers handle those cases. We also take motorcycle, workplace, product and brain injury cases from Elgin.

Do you need a lawyer, or can you settle it yourself?

Some small claims with a clear at-fault driver and minor injuries settle without a lawyer. A claim with surgery, lasting symptoms, disputed fault, a commercial defendant or an uninsured driver is harder, and an early settlement offer closes the file for good once you sign the release. If you are unsure which category yours falls into, we are glad to look at it with you. Our Chicago area personal injury team works with clients across the northwest suburbs, and you can schedule a free consultation to talk through the facts.
