Where do Fullerton crashes tend to happen?

Look at a map and the pattern is clear. The 57, the 91 and the 5 all serve the city, and Harbor Boulevard, Orangethorpe Avenue and Beach Boulevard (State Route 39) feed traffic into and out of the freeways. Drivers coming off a ramp often brake late, and the cars behind them are watching mirrors, not the road ahead.

Imperial Highway, which is also State Route 90, adds another heavy east-west route. On those arterial roads the common injuries come from red light running, unsafe left turns and drivers pulling out of shopping centers. Nothing about those causes is unusual, but a good case still needs proof that one of them happened, and that proof comes from video, witnesses and the vehicles.

Students, bikes and scooters

California State University, Fullerton, Fullerton College, Hope International University and Marshall B. Ketchum University all draw large numbers of young people into the city. Many get around on bikes, e-bikes, scooters and skateboards, and many drive older cars with minimum insurance.

Collisions between a vehicle and someone on a bike or scooter produce arguments quickly. The driver says the rider came out of nowhere, and the rider says the driver never looked. Things that settle it: where the bike ended up, damage to the vehicle, the lighting and photos from the same hour, if possible. California’s comparative fault rule means that a rider who made a mistake can still recover part of the damages.

Students often worry about their insurance, their parents’ policy or their college health plan. Tell us about every policy you have, since more than one can apply.

Six kinds of proof after a Fullerton bike or scooter crash, from photos and vehicle damage to witnesses and policies

Downtown, the train station and a night out

Downtown Fullerton and the Fullerton Transportation Center, which is served by Metrolink and Amtrak, bring foot traffic at all hours. Restaurants, bars and the station put pedestrians in crosswalks at night, and drivers who have been drinking are one of the hazards of any place with a nightlife.

If you were hit as a pedestrian, or in a rideshare on the way home, get the driver’s details and the trip record before you close the app. If an impaired driver caused the crash, that driver’s insurer is only one source of money. Anyone who held liability for how the driver got to that point may be part of the case.

What about trucks on the 57 and the 5?

The 57 and the 5 carry freight, and Fullerton’s streets see delivery vans and box trucks all day. A collision with a commercial vehicle is more serious simply because of weight, and it often involves a company as well as the driver. Hours-of-service records, maintenance logs and the truck’s electronic data are the type of evidence we ask the carrier to preserve in writing. If the company delays, the data can be overwritten.

Motorcycles and the road surface

Riders feel every pothole, patch of gravel and sudden lane change. A motorcycle crash in Fullerton often begins with a driver who turns left across a rider’s path and says afterward that they never saw the bike. Others begin with a road defect: a bad seam, a patch of sand or debris. A defect on a public road puts the city or state on the list of possible defendants, and with that comes the six month claim rule described further down.

Riders also face a bias that jurors and adjusters sometimes bring. They assume the rider must have been speeding or reckless. Photographs, skid evidence and witness accounts are how we answer that assumption with facts. Gear, lighting and speed all get examined, and we prepare you for those questions.

Parking lots, apartments and shopping centers

A lot of injuries in Fullerton are not on the road at all. Cars strike pedestrians in shopping center lots along Harbor Boulevard. Tenants fall on cracked steps or in dim walkways. A customer slips on a spill in a grocery aisle. In each of these the question is whether the owner or manager knew of the danger, or should have, and how long it was there.

Take photos before the hazard is fixed, report it in writing if you can, and keep the shoes you were wearing. If you tell a manager in person, write down the date and the person’s name afterward.

Work and construction injuries

Many people hurt at work in Fullerton get workers’ compensation, which covers medical care and part of lost pay without any proof of fault, under its own deadlines. If someone besides your employer caused the injury, such as a subcontractor on a shared site, a driver who hit you on a delivery route or a company that made a faulty tool, you may also have a claim against that person or company. That claim can include damages that workers’ compensation does not pay, including pain and suffering.

Construction sites usually involve several employers working side by side, which makes it harder to say who controlled the hazard. We look at contracts, safety plans and the site’s own records.

If the other driver is gone or uninsured

Hit and run crashes and uninsured drivers are a reality in Orange County. If you carry uninsured motorist coverage, your own policy may pay. Those claims are decided by your insurer, which can be as hard to deal with as any other, so the documents and the police report matter just as much. Report the crash immediately, look for cameras, and ask nearby businesses whether their footage shows the vehicle.

When a family loses someone

Under California law, a wrongful death claim can be brought by the person’s surviving spouse or domestic partner, children, and the children of a deceased child. If none of them survive, it passes to the people who would inherit from the person under California’s intestate succession rules. Others can sue if they were financially dependent on the person who died, including a putative spouse, stepchildren and parents, and so can a minor who lived in the household for the previous 180 days and relied on the person for at least half of their support. The personal representative of the estate can also bring the claim on the family’s behalf, as Code of Civil Procedure section 377.60 provides. The claim can recover funeral and burial expenses, lost financial support and the loss of the person’s love and companionship, and the same two year deadline normally applies. We handle these cases carefully and with respect for how hard the timing is, explaining each stage as it comes up.

When the defendant is a school or a public agency

An injury on a city street, a park, a school campus or a public bus raises a different set of rules. Before you can sue a public agency in California, you generally have to present a written claim to it within six months of the injury, under Government Code section 911.2. Late claims are sometimes possible, but the rules are strict and they are not something to count on.

This catches students and parents especially, as it applies to campus incidents at public schools and colleges. Write down what happened soon and talk to a lawyer well within the six months.

Will they say the crash was too minor to hurt you?

A frequent insurer argument in a low-speed collision is that the vehicle damage was small, so nobody could have been seriously hurt. Doctors see otherwise: people are injured in low-speed impacts, particularly in the neck, back and shoulder. We rely on your treating doctors, your records and the vehicle photos to answer the claim, and we do not let a repair estimate set the value of your injury.

The way you handle the insurer’s first calls matters, too. Our guide on dealing with insurance companies after an accident in California explains what adjusters ask and how to respond.

Six ways to answer an insurer's minor crash argument after a Fullerton collision, from treating doctors to repair estimates

Where the case would be heard

Fullerton is in Orange County, and its lawsuits are filed in the Orange County Superior Court. Under the court’s designation list, unlimited civil cases are heard at the Central Justice Center, 700 Civic Center Drive West in Santa Ana. Cases designated complex go to the court’s Civil Complex Center, also in Santa Ana. Your own presence in court is limited in most cases, and we handle the filings, which for represented parties are made electronically, so you are not left to figure out a courthouse alone. Limited civil cases, those worth up to $35,000, are heard in Santa Ana.

What does treatment and recovery look like?

Providence St. Jude Medical Center is in Fullerton, and you may also see providers elsewhere in the county. Whatever provider you use, consistent care and clear notes are the foundation of a claim. Gaps, missed appointments and vague complaints invite the insurer to doubt you. If you have no health insurance, tell us. Many doctors will treat on a lien, which gets repaid from a settlement, and we negotiate those liens down at the end so more of the recovery reaches you.

How long do you have to file?

Under Code of Civil Procedure section 335.1, most personal injury and wrongful death lawsuits in California must be filed within two years. Under California’s comparative fault system, a jury reduces your damages by your own percentage of responsibility instead of denying them altogether.

Which Fullerton cases do we take?

Most of the Fullerton cases we see begin on the road. Collisions on the 57, the 91 and the 5, and turning crashes on Harbor Boulevard and Orangethorpe Avenue, are handled by our Orange County car accident lawyers. When a semi or a delivery truck is involved, a carrier and its insurer enter the case, and our Orange County truck accident team works it from the start.

When a crash or another person’s negligence takes a life, the family’s claim follows its own rules about who may bring it and what it can recover. Our Orange County wrongful death lawyers handle those cases. We also take pedestrian, bicycle, scooter, workplace and premises injury cases from Fullerton.
