However, the city is cut in half by two major highways: the 405 and Highway 5. In California, they are called "The 405" and "The 5" because of their immense importance to our daily lives. The majority of commutes from one city to another take place on these two highways.
Large Commercial Vehicles and Local Roadways
Guess who travels on these highways among tiny family cars: 18-wheeler trucks. They usually travel from San Bernardino down Highway 91 toward Corona, then down the 133 or 55 to reach Highway 5 or the 405. Often frustrated by congested traffic, these truck drivers try to find speed whenever they can. They may take shortcuts to avoid high-traffic areas, and on the small roads of Irvine and Orange County, it can feel like Godzilla vs. the people.
These incidents cause severe injuries, including fractured hands, spinal damage, and sometimes traumatic brain injuries. There are frequent reports of fatalities on these highways, giving rise to wrongful death cases. I, Sean Chalaki, have handled many truck accident cases dealing with Trucks making wide turns and climbing over cars. That is why I maintain a dashcam on my vehicle to ensure I capture their wide turns and stay out of their blind spots.
If you were hit by a commercial truck on the 405 or the 5 through Irvine, the first call should happen before the carrier's ELD overwrites and before the dashcam recycles, because that window is measured in days, not weeks.
Bring the police report or incident number, photos and videos of the scene and vehicles, your insurance information, and contact details for witnesses. Gather medical records, discharge summaries, prescriptions, and bills from any provider that treated you. Include pay stubs or employer letters showing time missed and reduced hours. If available, save dashcam clips, towing and repair estimates, and communications from any insurer. The Federal Motor Carrier Safety Administration’s Large Truck Crash Causation Study found that 13 percent of commercial motor vehicle drivers in crashes were considered fatigued. In California, commercial motor carrier operations are regulated and California Vehicle Code section 21702 restricts excessive hours for certain drivers. Strong evidence includes electronic logging device data, dispatch timelines, fuel receipts, toll records, and driver statements. Medical records and expert fatigue analysis can link delayed reactions or lane departures to over-hours driving, strengthening liability and damages.
Rear-end crashes involving trucks can cause significant injuries because of the size and weight difference. These collisions often occur on the I-5 and I-405 during congestion when sudden stops happen. They can also happen at intersections when a driver misjudges stopping distance. Proving fault usually focuses on following distance, speed, and driver attention. Data from the truck’s engine control module and dashcam footage are especially helpful in showing late braking or distraction and strengthening a civil claim for damages.
We move immediately to preserve ELD data, ECM downloads, dashcam footage, dispatch logs, and maintenance records before they are altered or routinely overwritten. Whether the crash happened on I-405, I-5, or a surface street, spoliation letters go out fast.
Once treatment stabilizes and the file is built, we prepare a detailed demand letter to the at-fault carrier and insurer. It outlines liability, damages, future care, and noneconomic losses with supporting records.
